The Software is owned by infotectonica and is copyrighted and licensed, not sold. infotectonica retains all right, title and interest in and to the Software including, without limitation, all intellectual property rights relating to or embodied in the Software.

You may not reverse engineer, disassemble, decompile or alter the Software in any way except to the extent that the foregoing restriction is expressly prohibited by applicable law.

You agree to use the Software in compliance with all applicable laws and regulations including all laws governing the export or re-export of the Software. You agree to indemnify infotectonica from and against your violation of any such laws or regulations.

THE SOFTWARE IS LICENSED TO THE USER ON AN "AS IS" BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, NONINFRINGEMENT OR FITNESS FOR PARTICULAR USE OR PURPOSE. INFOTECTONICA DOES NOT WARRANT THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE SOFTWARE WILL BE CORRECTED. You the user are solely responsible for determining the appropriateness of the Software for your use and accept full responsibility for all risks associated with its use.

IN NO EVENT SHALL INFOTECTONICA BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS OR DATA, ARISING OUT OF THIS AGREEMENT OR USE OF THE SOFTWARE. IN NO EVENT WILL INFOTECTONICA BE LIABLE FOR (a) ANY DAMAGES IN EXCESS OF THE AMOUNT INFOTECTONICA RECEIVED FROM YOU FOR A LICENSE TO THE SOFTWARE, EVEN IF INFOTECTONICA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY REMEDY, OR (b) FOR ANY CLAIM BY ANY THIRD PARTY.

Some jurisdictions do not allow for the exclusion or limitation of implied warranties, so the above limitations or exclusions may not apply to you.

This Agreement is governed by the laws of Luxembourg.

This Agreement is the complete agreement we have regarding your use of the Software, and replaces any prior communications, understandings or agreements.

If any provision of this Agreement is held to be unenforceable, such provision will be deemed modified only to the extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.
